Mahama has violated the law with ‘Montie 3’ sentence remission – Pressure Group

A pressure group in the Eastern region, ‘Eastern Patriots’ has condemned the remission of sentence given to the ‘Montie’ trio by President Mahama on Monday.

In a press statement signed by the convener of the group, Nana Asembi Nti, the president and the Council of State acted in ignorance of the laws of the land.
Speaking to primenewsghana.com, the secretary of the group, Ratina Kissi indicated “the president acted with no due respect to the judiciary” adding “an attack on the judiciary is an attack on the state.”
Mr. Kissi further pointed out the ‘Montie’ trio “never showed remorse for their action as they said big guys have been in prison before so no case if we go to jail.”

PRESIDENT JOHN MAHAMA HAS UNDERMINED THE JUDICIAL ARMS OF GOVERNMENT,  THE EXECUTIVE ARMS OF GOVERNMENT HEADED BY PRESIDENT JOHN MAHAMA IS A JOKE- EASTERN PATRIOTS


 It is with great concern that we are issuing this statement to express our disappointment in the President of Ghana , John Dramani Mahama.

 With due respect, why must the president of this nation ignorantly act against the laws of the land?

 If we may ask, did the ignorant council of state really advised the president to invoking Article 72 of the 1992 Constitution of Ghana or they just quoted it for him because it speaks of prerogative of mercy?

 To refresh the mind of our president and his council of state, the Military governments knew better to enact our applicable laws to exempt -among others which Mr president should visit to update himself of our laws.

 It is true the 1992 constitution's Article 72 speakers of the PRESIDENT'S PREROGATIVE OF MERCY , however there are EXCEPTIONS;

 COMMITTAL TO PRISON FOR CONTEMPT as per subsection (3)(d) of the Act below.

 PRISONS SERVICE ACT - 1972 (NRCD 46)

 Section - 34 - Remission for Good Conduct

 (1) Subject to subsection (3), a prisoner serving a sentence of six weeks or more may by steady industry and good conduct earn a remission not exceeding one-third of his sentence.

 (2) All or any part of the remission so earned may be forfeited in accordance with regulations for failure by the prisoner to maintain steady industry or good conduct.

 (3) This section shall not apply in the case of a prisoner who is-

 (a) serving a sentence of imprisonment for life;

 (b) detained during the pleasure of the National Redemption Council;

 (c) committed to prison for debt; or

 (d) committed to prison for contempt of court.

 The whole issue has been reduced to politics of family and friends by the president. The president has no shame
 to be interfering in the work of the Juduciary arms of government.

 This is not only most unfortunate but a bad precedent of political segregation by President John Dramani Mahama.
