High Court to hear Ndoum, EC oral submission on Tuesday

PPP presidential aspirant, Dr. Papa Kwesi Nduom and the Electoral Commission (EC) have a Monday deadline to meet in filing statements making their case as to why Ndoum must be on the ballot or otherwise.

The High Court also set Tuesday as the day for oral submissions to be heard with ruling on the matter scheduled a week later.

Although Dr. Nduom with 13 other presidential aspirants suffered disqualification, It is the Progressive People’s Party’s (PPP) leader who has kept sustained pressure on the commission for his reinstatement going to radio stations to make his case while effectively using social media platforms Facebook and Twitter to devastating effect.

While the EC Chair maintains Dr. Nduom got disqualified because he did not meet the requirements of Regulation 7 (2) (b) of C.I. 94, Paa Kwesi Nduom insists C.I. 94 which governs the elections requires the EC to have drawn his attention to any error for corrections to be effected as former chairman, Afari Gyan did.

He particularly felt grieved when as he put it three of four aspirants the EC gave pass marks to including Nana Addo, Dramani Mahama and Greenstreet had all failed in certain requirements but were considered except he who had complied with most the EC’s requirements got treated poorly.

Thaddeus Sory representing the EC, prayed the court for a speedy hearing so ballot papers could be printed with placement of aspirants done in time ahead of the December 7 polls.

Ayikoi Otoo representing the interest of Dr. Nduom concurred but pointed out his client’s grievances must be heard and its veracity ascertained although he pleaded for more time since his client was out of the jurisdiction but Justice Eric Kyei-Baffour directed that Hon Ayikoi Otoo and his client file their statement supporting their case via email by the close of Friday.
