EC vs Nduom: Supreme Court hears case today

The Supreme Court will today November, 4 hear the Electoral Commission's (EC) application for the quashing of a High Court order to the Commission to allow flagbearer of the Progressive People's Party (PPP),  Dr Paa Kwesi Nduom amend errors found on his nomination forms.

The EC on October 10, citing errors on Dr Nduom's forms, disqualified him from contesting the December elections saying the errors breached the laws governing elections in Ghana but Dr Nduom filed a suit at the Accra High Court asking the court to nullify the Commission's decision which the court obliged. 

In his ruling on Friday, presiding judge Justice Eric Kyei Baffour said the failure of the EC to allow Dr. Nduom amend the errors was against the rules of natural justice.

However, the EC on Monday, after a review of the High Court ruling filed suit at the Supreme Court to invoke its supervisory jurisdiction to quash Justice Kyei Baffour's decision.

The EC is arguing that the High Court committed an error of law apparent on the face of the record;  wrongly assumed jurisdiction of the matter; and exceeded its jurisdiction.

The Supreme Court on Wednesday granted an abridgement of time for the hearing of the suit and moved the date from next week to this to day with Justice Scott Pwamang  while directing Dr. Ndoum’s lawyer to file statement by Thursday noon.
