Tamale High Court has granted bail to a 28-year-old suspect, Ernest Green in an alleged rape case brought against him by Daniela Maltiti, 32, and expatriate.

The presiding Judge, Justice Osei Kwame Gyamfi cited sections of a case between Michael Gbenu vrs the Supreme Court on bail conditions which specified circumstances under which a bail could be granted in cases of assault, rape, and murder.

Justice Gyamfi explained that "the bailing of the suspect could interfere in investigation; the bailing of a suspect could endanger the life of the victim, or the failure by suspect to report to the police per previous conduct".

He added failure by the police to provide medical report of victim as of Tuesday April 17,2018 and the refusal by the police to subject the suspect to immediate medical checks of semen even when he availed himself was enough to grant him bail.

Justice Gyamfi therefore upheld the bail application considering police's refusal to pick the bed sheets on the hospital bed used by the complainant, Daniela Maltiti amount to a shoddy work by the police.

Background

Ernest Green was arrested by the Damongo police following reports made by Daniela Maltiti to the Italian Embassy and one Dr . Martin, a physician assistant that he had raped her whilst she was on admission at the West Gonja Hospital.

The accused person who has pleaded not guilty to the charge of rape has since been in custody in Tamale pending police investigation into the matter.
