High Court issues bench warrant for arrest of CID boss

An Accra High Court has issued a bench warrant for the arrest of CID Boss, Deputy Commissioner of Police (DCOP) Faustina Agyeiwaa Kodua Andoh-Kwofie and the Director-General Legal and Prosecution unit of CID for failing to appear in court after being charged for contempt.

Presiding judge, Justice Lydia Osei Marfo issued the order after evidence showed that both officers of the law had been accordingly served by Court officials.

The Director General of CID and the Director General Legal and Prosecution unit have been cited in a suit filed by car rental company, Sureword Global Outreach.

The court had earlier ordered for the respondents to release a vehicle belonging to the applicant but the Police “blatantly refused” and also failed to appear before the Court despite a number of summons.

Background

Per the brief facts available at the court, on November 14, 2023, the Police impounded a Toyota Fortuner with registration 2925-20 after finding substances suspected to be illicit drugs.

After discovering that the driver, Julius Noagbe rented the vehicle from Sure Rental, a call was placed to owners of the vehicle to inform them of the detention.

In its affidavit in support, Sureword Global Outreach indicated that Sure Rental is a sister company and noted that it was not criminally liable for activities perpetrated by its client upon rental and prayed the court to order the police to release its vehicle.


The company also noted that due to its inability to use its investment, Sure Rental was running losses. The Achimota District Court therefore issued an order for the release of the vehicle as investigations continued since Mr Noagbe was in Police custody.


But the Police failed to release the vehicle blatantly disregarding the court order.


The applicant therefore filed a contempt case at the High Court where the respondents, CID Director General, Deputy Commissioner of Police (DCOP) Faustina Agyeiwaa Kodua Andoh-Kwofie and the Director General Legal and Prosecution unit of CID of the Ghana Police were served to appear in court.

When the case was called on Monday, April 15, 2024, Counsel for Sureword Global Outreach, Abraham Arthur, prayed for CID boss and Director General of Legal and Prosecution Unit to be cited for contempt for not honouring the Court’s order.


He argued that the Court’s order through the IGP to the respondents had been blatantly disregarded though they had been served.

Justice Lydia Osei Marfo therefore indicated that no one is above the law and issued the warrant for the arrest of the duo.
