Supreme Court orders Gitmo 2 agreement released to lawyers

Ghana's supreme court has declared that the agreement between the government and the United States leading to the importation of two Guantanamo bay detainees, Mahmud Umar Muhammad Bin Atef and Khalid Muhammad Salih Al-Dhuby must be disclosed albeit only to lawyers handling the case.

Bin Atef and Al-Dhuby who were accused by the U.S government of having links with terrorist group Al-Qaeda had been detained for 14 years.

Citizens, Henry Nana Boakye and Margaret Bamful reckoned the Gitmo 2 were forced on Ghanaians without due process so sued the Attorney General (AG), Interior Minister and president Mahama for better clarification of Article 75 of the 1992 Constitution by the apex court.

The AG had posited that the agreement was confidential and any disclosure in public or open court would violate section 1 of the State Secrets ACT, 1962 (Act 101) but the judges held, no security threat shall be posed with the disclosure.

When Ghanaians got to know about the Gitmo 2, there were agitation for their export but government and the United States Embassy in Ghana, assured, the two men posed no national security threat.
