EC vs Nduom: Supreme Court ruling on Monday

The Supreme Court has set Monday, November 7,  make a ruling on the suit between the Electoral Commission and the Progressive People’s Party over the disqualification of its flagbearer, Dr Paa Kwesi Nduom from the December 7 polls.

The seven-member panel presided over by Justice Sophia Adiniyira will determine if the High court ruling asking the EC to allow Dr Nduom to correct the errors on his nomination form should stand or not.

The EC on October 10, citing errors on Dr Nduom's forms, disqualified him from contesting the December elections saying the errors breached the laws governing elections in Ghana but Dr Nduom filed a suit at the Accra High Court asking the court to nullify the Commission's decision which the court obliged.

In his ruling on last Friday, presiding judge Justice Eric Kyei Baffour said the failure of the EC to allow Dr. Nduom amend the errors was against the rules of natural justice.

However, the EC on Monday, after a review of the High Court ruling filed suit at the Supreme Court to invoke its supervisory jurisdiction to quash Justice Kyei Baffour's decision.

The EC is arguing that the High Court committed an error of law apparent on the face of the record;  wrongly assumed jurisdiction of the matter; and exceeded its jurisdiction.

The Supreme Court on Wednesday granted an abridgement of time for the hearing of the suit moving the date from next week to this Friday to hear oral arguments from lawyers of the parties.
