Special Prosecutor Bill, a disguised form of political persecution?

The introduction of the office of the special prosecutor will be a disguised form of political persecution.

That’s according to the Member of Parliament for Sagnarigu A.B Fuseini, who has described the efforts of the New Patriotic Party administration to introduce a law that will establish an office of a special prosecutor to fight corrupt practices in the country, as a way to go after their political opponents.

The NPP in the quest to fight corruption in the country promised to establish an office of the Special Prosecutor that will be independent of political influence in the fight against corruption.

The Special Prosecutor Bill was laid before Parliament but was withdrawn after the Minority Parliament raised concerns that it was not gazetted 14 days before being laid as required by law. 

Commenting on the bill on Radio Gold's Alhaji and Alhaji program, Mr Fuseini said despite the government's Majority in Parliament, the bill was beset with elementary problems leading to its withdrawal.

He further stated that the NPP is looking very clueless and having problems in delivering on the promises they made to Ghanaians.

Meanwhile, a former Attorney General Martin Amidu has quizzed certain aspects of the Special Prosecutor Bill.
In his view, Clause 3 (3) and (4) of the Bill, which was not in the original draft designed by stakeholders, including Civil Society Organizations, limits the powers of the special prosecutor.

The clauses; “…specified under paragraphs (a), (b) and (c) of subsection (1) unless the commission of the offence is in respect of a vast quantity of assets that (a) constitute a substantial proportion of the resources of the country; (b) threaten the political stability of the country; or (c) threaten the sustainable development of the country.”

He added that President Nana Akufo-Addo is being set up to be embarrassed by some faceless persons who clandestinely introduced the clauses into the to limit the prosecutor's ability to investigate certain kinds of corrupt activities.
