High Court dismisses application for National Security account disclosures in Adu-Boahene case

The Accra High Court has dismissed an application seeking comprehensive disclosure of National Security operational accounts spanning six presidential administrations since 1992.

Presiding Judge Eugene Nyadu Nyantei rejected the motion filed by defense counsel Samuel Atta Akyea on July 3, 2025, ordering the trial to proceed on July 18.

The application, submitted June 26 on behalf of defendants Kwabena Adu-Boahene, Angela Adjei Boateng, Mildred Donkor, and Advantage Solutions Limited, sought account records from administrations including Rawlings (1992-2001), Kufuor (2001-2009), Mills (2009-2012), Mahama (2012-2017), Akufo-Addo (2017-2025), and the current Mahama administration. Atta Akyea argued the Attorney-General selectively disclosed information to strengthen prosecution while withholding potentially exculpatory evidence.

Deputy Attorney-General Dr. Justice Srem Sai opposed the motion, contending the request was irrelevant to the core charges of diverting government funds to a private entity. Court records confirm the defendants face 11 counts including conspiracy, stealing, money laundering, and causing financial loss. All maintain not-guilty pleas and remain on bail.

Following the dismissal, Atta Akyea requested adjournment to consider an appeal, alleging document withholding by prosecutors. Dr. Srem Sai pushed for expedited proceedings, prompting heated exchange in courtroom transcripts. The ruling aligns with heightened judicial scrutiny under President Mahama’s governance reforms, including recent audits of high-profile projects initiated under previous administrations.
