The Mortuaries and Funeral Facilities Agency (MoFFA) has directed all mortuaries and funeral facilities operating without valid licenses to regularize their operations within one week or face sanctions, including possible closure.
The Agency, in a statement issued on October 22, 2025, stated that it was concerned about the fact that a number of mortuaries and funeral homes were still operating without the necessary licenses, which is in violation of Section 55 of the Health Institutions and Facilities Act, 2011 (Act 829).
“The Mortuaries and Funeral Facilities Agency (MoFFA), established under Part Two of the Health Institution and Facilities Act, 2011 (Act 829) with the object to license, control and regulate all facilities connected with the storage, transportation and disposal of human remains wishes to inform the general public, both private and public mortuaries and funeral facilities that are operating without the requisite license to take immediate steps to regularize their operations with the Agency within one (1) week from the date of this publication,” parts of the statement read.
The law stipulates that any person who operates a facility without proper registration or licensing commits an offence and is liable to a fine or the temporary or permanent closure of the facility.
MoFFA cautioned that any facility that fails to comply with the directive within the given timeframe risks being shut down.
The Agency reiterated its mandate to license, control, and regulate all establishments involved in the storage, transportation, and disposal of human remains.
