Move to oust Special Prosecutor underway

There are moves to remove the Special Prosecutor, Kissi Agyebeng from office before the end of the first half of this year.

The attempt to remove Kissi Agyebeng from office comes on the back of a petition by Martin Alamisi Amidu for the removal of honourable Kissi Agyebeng from office as Special Prosecutor on five grounds including holding a press conference to decry how the courts were handling cases of the Office.

Consequently, this paper has learnt that the Chief Justice Gertrude Sackey Torkornoo, has written to the Special Prosecutor to provide comments to the allegations raised in the petition to enable the lady Chief Justice determine whether there is a prima facie case against him.

Excerpts of the letter read “This is to forward to you a copy of petition dated 30th April, 2024 sent to the Office of the President which was forwarded to the Office of the Honourable Lady Chief Justice on 6 May, 2024."

Prima facie is Latin term which literally means “at first appearance” or “on the face of it”. It is used in both civil and criminal law to denote that, on its face, sufficient evidence exists to support a case.

Sources say the allegations for Kissi Agyebeng’s removal are largely about allegations that the Special prosecutor denied Mr. Amidu’s application for information on appointment letters and salaries of all staff of the office as exempt under Right to Information Law.

The other allegations that he has been abusing rights of citizens through arrests and detentions, abuse of judges and the administration of justice by holding a press conference, alleged procurement and appointments breaches.

Our sources indicated that all these happenings are attempts to replace Kissi Agyebeng with a softer person who would play to whims and caprices of the powers that be.

“We cannot be sure of the OSP, his position on some issues has been problematic for us. Going forward we need a softer hand that listens to instructions and carries them out in our interest” our insider source intimated

This also comes on the heels of failed attempts by the powers that be to sponsor persons to rundown the Special Prosecutor by courting public disaffection against him.
